Types of Construction Cases We Handle

Construction Contract Disputes
We represent clients in conflicts over obligations and responsibilities in construction contracts, addressing delays, contract breaches, and scope-of-work disagreements. We strive to minimize disruption to the progress of the project while protecting your investment and property rights.
Payment and Mechanic’s Lien Claims
Contractors, subcontractors, and suppliers have the right to place a mechanic’s lien on property owners and developers to recover unpaid invoices and payment for work completed. We secure timely payment and initiate legal action for damages as appropriate. We also represent parties in mechanic’s lien challenges.
Delay and Schedule Disputes
Our Englewood construction lawyer effectively resolves disputes related to project delays, missed milestones, and related claims for damages or extensions. Our understanding of construction industry practices ensures that the resolution we achieve protects your investment and keeps you on track for completion.
Defect and Warranty Claims
We represent owners, developers, and contractors in claims involving construction defects, faulty workmanship, or breach of warranty. We carefully review the contract, warranty, and other documents to determine your legal options, which can include pursuing damages. We also represent parties who are alleged to be responsible for the defects or warranty breach, while taking steps to mitigate financial and operational risks.
Change Orders and Scope of Work Conflicts
Change orders are often contested, especially when contracts lack clear provisions for submitting change orders or cost overruns. We strive to find an acceptable solution to project modifications and scope-of-work conflicts, while ensuring that contractual obligations are enforced.
Construction Arbitration and Litigation
We guide clients through arbitration, mediation, and court proceedings involving construction disputes. We use our trade-specific knowledge and negotiation skills to achieve a favorable result for our clients. Should the matter go to trial, we present compelling arguments for your position to convince a judge and jury.
Owner, Contractor, and Subcontractor Representation
We represent all parties in construction projects, including property owners, general contractors, and subcontractors. Because we’ve successfully represented each of these parties, we understand how to counter any argument the other party in your dispute makes, and the most effective solution to the matter.
Construction law involves not just legal compliance, but also compliance with state and local building codes, safety compliance, and negotiating a favorable deal.
