As experienced construction law attorneys, we know the unique challenges disputes in the construction industry encompass. If a frank conversation with the other party, outlining the options open to them, fails to get the results you need, then we escalate to arbitration or litigation. Our legal team builds a strong, evidence-based case to support your position, so we’re prepared no matter what the other side does. And, if you’re owed damages, we properly value your losses, including any extra damages you may be entitled to, then vigorously pursue every penny.

Types of Construction Dispute Cases We Handle

Construction Contract Disputes
We represent clients in disputes arising from construction contracts, including delays, scope-of-work disagreements, and breach of contract claims. If the dispute has cost you money, we pursue the full amount of damages owed through enforcing contractual rights.
Payment and Mechanic’s Lien Claims
We help contractors, subcontractors, and suppliers secure payment for unpaid work and supplies. A mechanic’s lien is often an effective way to get the money you’re owed, but these can be contested. We advocate for your lien rights. Our Englewood construction dispute lawyer also represents parties who have had a lien filed against them, contesting incorrect liens and negotiating a fair resolution to disputed payments.
Delay and Schedule Disputes
Our firm handles conflicts that come up after project delays, missed milestones, and schedule adjustments. If you have a claim for damages, we seek a fair amount of compensation. We also represent parties who, through no fault of their own, caused a schedule disruption, helping you mitigate any financial penalties while preserving your business relationships.
Defect and Warranty Claims
Our goal is to achieve a fair resolution to construction defects, focusing on making sure that any solution keeps the structure safe and to code. Volpe Law represents owners, developers, and contractors in these matters, and as experienced contract attorneys, we have a full understanding of your rights and what damages you may be entitled to. We seek a fair resolution while protecting your financial and operational interests.
Change Orders and Scope of Work Conflicts
Our legal team resolves disputes arising from change orders, design modifications, and disagreements over project scope. We review the contracts and other project agreements to find an acceptable solution and keep your project on track. If we cannot resolve the dispute or if you’re owed damages, we may initiate litigation or negotiate a fair settlement for you.
Construction Arbitration and Litigation
Many construction contracts include an arbitration clause, which avoids litigation; our Englewood construction dispute lawyer represents you in this process. If arbitration isn’t an option, we initiate litigation on your behalf, seeking fair damages if you’re entitled to them. We also represent defenses in these matters, building strong cases to repudiate allegations from the other party.
Owner, Contractor, and Subcontractor Disputes
We represent all parties involved in construction projects, including property owners, general contractors, and subcontractors. We know the rights each party has and the steps to protect them. Because of the comprehensive approach we take, we’re often able to resolve disputes that seem insurmountable.
At Volpe Law, LLC, we advocate for our clients’ rights in a construction dispute, protecting their investment and hard work. We’ve represented both plaintiffs and defendants in construction litigation, as well as advising clients in mediation and advocating for them in arbitration. Our goal is an effective resolution that satisfies all parties when possible, or a seamless exit strategy should the parties need to part ways.
