International Defamation – ICC Mediation
State court proceedings stayed to allow for mediation of a defamation claim under the rules of the International Chamber of Commerce (ICC) in Paris. After 12 hours of negotiation, the parties reached a settlement that satisfied all of the client’s stated goals from the beginning of the dispute. The client did not seek monetary damages and ultimately vindicated their good name.
Insurance Bad Faith – Colorado Consumer Protection Act Claim
Clients brought a novel Colorado Consumer Protection Act claim against an insurance company for post-contractual claims handling practices. The defendant insurance company aggressively sought to have the claim dismissed via a motion to dismiss to avoid expansive discovery. The Court denied the motion to dismiss and preserved the possibility of treble damages.
Commercial Eviction – AI-Generated Counterclaims Dismissed
In a straightforward eviction case (failure to pay rent), the tenant utilized AI to raise five different specious counterclaims. The client’s initial counsel did not have the expertise to handle the matter and referred the case to our firm. Volpe Law filed a motion for judgment on the pleadings a few days before trial and the Court granted the motion, dismissing all counterclaims and avoiding the time and expense of a trial. Additionally, Volpe Law identified a guarantor not initially named in the complaint, convinced the Court to allow a late-stage amendment, and the guarantor ultimately agreed to pay under a settlement agreement.
Retirement Savings Recovery – $300K Mediation Settlement
Clients utilized the discovery process to compel the defendant to mediation. The parties reached settlement during a full-day mediation. The defendant ultimately agreed to pay approximately $300K in settlement. As this sum represented the clients’ retirement savings, they could now enjoy retirement with peace of mind.
Unpaid Invoices – $64K Mediation Settlement
Client filed a complaint seeking approximately $140K in damages for unpaid invoices. Defendants pushed aggressively for mediation. After an intense full-day mediation, the parties agreed to accept $64K in full settlement.
Construction Defect – $285K Settlement
Remodel project involving construction defects and a double payment for countertops. $355,000 in costs of repair and $30,000 double payment at issue. Achieved a $285,000 global settlement.
Pipeline Condemnation – $65K Settlement
Pipeline condemnation action. Secured a $65,000 settlement from a property with less than $5,000 in appraised land value.
Construction Lawsuit Defense – Zero Out-of-Pocket
Client was sued for $500,000. We pursued third-party claims which reimbursed the client for unpaid work. Settlement reached with no money out of the client’s pocket.
Mechanics Lien Foreclosure – Full Invoice Recovery (~$25K)
Mechanics lien foreclosure for welding services. Pushed early written discovery on the owner and contractor, resulting in full reimbursement of the client’s invoice of approximately $25,000.
Mechanics Lien Defense – $45K Counterclaim Win
Client was sued for mechanics lien foreclosure. We flipped the tables with counterclaims and secured $45,000 for the client. No money paid to the contractor on their $20,000 lien claim.
Mountain Home Construction Defect – $155K Settlement
Client sued a construction company for defects in a mountain home. We took the case to arbitration and pushed hard, eventually earning a $155,000 settlement after a lengthy litigation battle.
