Flat Fee Business Counsel Subscription
A flat-fee business counsel subscription is a type of legal service in which the business owner pays a monthly fee for ongoing business advice and legal support rather than paying per hour or per project (or case). Growing businesses should allocate 1-2% of their annual revenue for legal costs.
For small to moderately sized businesses, start-ups, or growth-stage enterprises, this arrangement ensures that they have access to legal advice as needed and are able to reliably budget and control costs.
On-demand legal services shouldn’t be reserved for large corporations. The needs of niche entrepreneurs and growth-stage companies are just as important, and with our flat-fee, comprehensive advice, you can remain competitive in your market. Volpe Law’s Flat Fee Subscription Tiers
Our firm works with businesses of all sizes and at all stages of development, from developers and emerging enterprises to multi-owner partnerships and growth-stage companies. We understand that the needs of a start-up enterprise differ from those of an established small business with no plans for expansion. Therefore, we structure our flat-fee business counsel subscription into three tiers to best accommodate your specific needs.
- Tier 1: $1200 per month, 12-month subscription, for businesses that need only 0-3 hours of attorney time per month. We answer your legal questions, review and revise basic contracts, and offer advice on an as-needed basis. For stable businesses with minimal legal needs, this provides tremendous value (consider, for example, that you likely spend more on managed IT services per month). We’ve found that this arrangement helps manage your legal risk, saving you tens of thousands of dollars in potential legal costs.
- Tier 2: $2,500 per month, 12-month subscription, up to 7 hours of attorney time per month. For businesses that require additional support, face more frequent contract negotiations or other minor potential disputes, or are growing in revenue, size, and complexity, Tier 2 provides ample time for in-depth complimentary discovery calls and resolving the issues your organization faces.
- Tier 3: $5,000 per month, 12-month subscription, up to 15 hours of attorney time per month. For well-established businesses to stay lean while managing legal costs, it is essential to keep general counsel fractional yet still require quality legal advocacy and advice. This option is far more affordable than in-house counsel, about 25 – 33% of the cost of a full-time in-house attorney. You can manage legal risk and reap the benefits of the diverse experience and specialty knowledge our legal team possesses.
Litigation Representation Package
Is your business facing litigation? Whether you’ve received notice of a pending lawsuit or you’re ready to file litigation yourself, you can upgrade your current subscription to the Litigation Representation Package at a cost of either:
- $8,000 per month additional flat rate for district court, arbitration, and federal court matters
- $4,000 per month additional flat rate for county court matters (typically small payment/contract disputes)
You’ll work with our seasoned litigators, who are already familiar with your business structure and challenges and can proceed with confidence, knowing that we are dedicated to serving your best interests. You’ll have more certainty with budgeting and a clearer idea of the all-in cost of settling early vs. going to trial.
Average commercial litigation costs in state court vary widely depending on many factors, but generally end up between $100,000 and $200,000 in total, with a case life averaging between 1 and 2 years. Typical monthly costs vary widely between $50 and $25,000, depending on the case stage, motions practice, and expert analysis. To help control the monthly fluctuations, we offer a flat rate of $8,000 per month until case completion for our business subscribers.

FEES
A $5,000 retainer is required for all pre-litigation dispute cases, while active litigation matters have a minimum retainer of $10,000. As of 1/1/2025, attorney rates vary between $275 – $400/hour. These hourly rates are paid by the retainer account. Fees and retainers for contract reviews and smaller projects vary, with some cases best suited for a 1-2 hour paid complimentary discovery call at $350 per hour or $700 for two hours. All retainers are evergreen and refundable. Please call to inquire for further details.
