Executives, business owners, shareholders, and other professionals frequently enter into contracts as part of their everyday operations. From vendor agreements to partnership and stakeholder arrangements, business contracts are a core part of doing business in Colorado. Many of these contracts include clauses that mandate binding arbitration to settle any legal or contractual disputes. If you signed a legal agreement with an arbitration requirement for settling disputes or conflicts, you have the right to legal representation. Arbitration as a Legal Dispute Resolution Option
Arbitration is an alternative to traditional litigation. It provides a private setting for resolving legal disagreements that would otherwise be handled in open court. A dispute can be handled by arbitration if all parties agree to engage in the process. In many cases, though, arbitration as a vehicle for dispute resolution is contractually required.
Arbitration is a process that works similar in practice to a civil case. It is overseen and settled by an arbitrator, whose role is akin to a judge. The arbitrator hears arguments presented by each side, reviews evidence presented to support these arguments, and weighs the facts of the case. They then issue a decision, which may be binding. For an arbitration decision to be binding, both parties must agree to it, either by deciding before the process starts or, more commonly, in the contract each signed.
While arbitration mirrors the civil trial process in some ways, it also offers unique advantages which may better-suit your goals:
- It’s private. Unlike court proceedings, arbitration is not open to the public, which keeps sensitive business matters confidential
- There is greater scheduling flexibility; it’s not dependent on a court’s schedule, so it can be executed at the convenience of both parties
- You get a say in who oversees your case, as opposed to being assigned a judge
- Your matter is typically heard before a professional with specialized knowledge of the industry or subject matter involved in the dispute. Often, this results in more thoughtful, appropriate decisions
Is Arbitration Right For You?
Even though arbitration isn’t the same as a court trial, it still requires careful preparation. You must present your case and provide evidence to support your position. The rules in arbitration are less formal than in court (you may not be bound by traditional Rules of Evidence or Procedure, for example), but there is still a structure to follow. You can trust our arbitration lawyers serving the Castle Rock area to properly construct arguments supporting your position in accordance with proper arbitration protocol.
