When a business gets hit with a lawsuit, there are a few things to keep in mind before you respond or say anything or take any steps. The first piece of advice I give my clients is to stay calm, relax, and don’t engage negatively with the opposing party. The next thing I highly recommend is the obvious. The next thing you need to do is put a litigation hold on any evidence, documents, emails, text messages, pictures, invoices, anything that’s relevant to the matter that’s going to be relevant to the plaintiff’s claims or your defenses in the matter. You have a duty to disclose relevant and nonprivileged evidence to the other side. Remember,

Do not delay this process. If you delete or move or lose evidence, you can be sanctioned by the court and it can ultimately hurt your case. The last thing I would suggest is to prepare your version of the facts and your timeline of events. That is what you think happened versus what the complaint and the plaintiff says. And prepare that in accordance with your attorney’s instructions and be ready to have an initial lengthy meeting with your attorney about your version of the facts and how to respond to the complaint.
