Colorado Springs Arbitration Lawyer
Arbitration is an alternative dispute resolution method that helps disputing parties resolve a dispute without going to trial. In arbitration, you have the right to be advised and represented by an attorney, similarly to how you’d be represented in civil court. Our Colorado Springs, CO arbitration lawyer helps you achieve a positive outcome from the process, working within the state rules governing the arbitration process and advocating for your interests. At Volpe Law LLC, we support your position with evidence and a well-reasoned argument in your favor in arbitration. Call us today for a personalized complimentary discovery call.
Arbitration Lawyer Colorado Springs, CO
While arbitration is an alternative to litigation, it’s still adversarial, involving two parties with differing views on how to resolve their dispute. Often, arbitration results are final, leaving little room for appeal. So, your case must be strong, your legal advocate skilled, and the facts presented in your favor. With our experience representing both individuals and businesses in a wide range of disputes, we’re well-equipped to handle all your needs.
Arbitration in Colorado involves the parties involved presenting their arguments and evidence to a neutral third party for resolution. That party reviews the issues and renders a decision, which may or may not be binding (you can agree to this before arbitration or, if you’re in arbitration due to a contractual requirement, it may be binding per the contract). The arbitrator has the power to resolve the matter in favor of one of the parties and, depending on the case, award monetary compensation, injunctions, and other provisional remedies for the aggrieved party.
Our Colorado Springs arbitration lawyer prepares the case per Colorado rules of procedure, using the fine points of law and the evidence our investigators gather. While the rules of evidence differ from those in a civil trial and are usually more relaxed, there are still rules, and anything presented before the arbitrator must be submitted in accordance with them. We carefully follow these rules, so the arbitrator has everything possible to consider. Each step we take is focused on achieving the result you desire, preserving your business interests and needs.

Types of Arbitration Cases We Handle

Commercial Arbitration
Commercial arbitration covers a wide range of matters. Our firm represents business owners, shareholders, employees, and other interested parties in disputes involving contracts, partnerships, and complex commercial transactions. Our familiarity with industry norms and specific regulations ensures we develop a strong case for your position.
Construction Arbitration
Our attorneys advocate for owners, contractors, subcontractors, and developers in construction-related arbitration disputes. Many cases involve delays, defects, payment issues, and change orders, and there is often a lot of money riding on the outcome of the session. We strive to expedite the process and keep your project on track.
Consumer Arbitration
Consumer arbitration cases typically involve disagreements over consumer agreements. We represent clients across many different industries, including financial services, telecommunications, and service contracts. We strive for a fair resolution while following the terms of the consumer agreement.
Real Estate Arbitration
We handle arbitration matters involving commercial real estate transactions, leasing disputes, and property development agreements. As experienced commercial real estate attorneys, we understand the critical details that make a transaction successful. We prepare a strong case for your position, including researching chains of title and plat maps to help us bolster our position.
Partnership and Business Owner Arbitration
Many partnership agreements include an arbitration clause for resolving disputes. We work within the parameters of any existing partnership agreement, operating agreement, or other ownership contracts. Our goal is to preserve your business relationship, if this is your goal, or to secure fair damages or compensation if that’s your goal.
Pre-Arbitration Strategy and Award Enforcement
Some matters scheduled to go to arbitration may be resolved before the session in negotiations between the two parties and their legal representatives. We may be able to avoid binding arbitration (in which the arbitrator has the final say) and instead reach an out-of-court settlement in which you have more of a say. If the settlement meets your goals, then arbitration may not be necessary. We advise you of your options in these situations.
Let the Volpe Law LLC advocate for you in arbitration. We get to know you and your business goals so we can craft the best arguments in favor of them. Our Colorado Springs arbitration lawyer presents your case to the arbitrator, counters arguments made by the other side, and takes a strategic approach to resolving your matter. Contact our firm today to discuss your arbitration options.
